    Your Worship and Councillors:

    The General Government Committee presents Report No. 2021-01 and recommends:

    1. That City Council adopt the 2021 General Capital Budget as presented in attached Schedule “A” for Capital Projects to be funded from Capital Levy, Debentures, Federal and Provincial Government Grant Programs, Development Charges, Reserves and other contributions totalling $31,106,389.00 (save and except for: Project #3711RF – City of North Bay Community and Recreation Centre $17,000,000.00; and Project #4130RD/ST – Business and Industrial Park Development Design $180,000.00);
    2. That City Council adopt the 2021 Water and Wastewater Capital Budget as presented in attached Schedule “B” for Water and Wastewater Capital projects to be funded from Water and Wastewater Rates, Debentures, Federal and Provincial Government Grant Programs, Development Charges, Reserves and other contributions totalling $13,226,243.00 (save and except for Project #4130SS/WS – Business and Industrial Park Development Design $170,000.00);
    3. That Council authorize the reserve transfers and cancellation of capital funding authority as detailed in Appendix B to Report to Council No. CORP 2020-120 dated November 13, 2020;
    4. That City Council approve the required transfers to and from the various funds in accordance with the 2021 Adopted Capital Budgets;
    5. That City Council authorize the Chief Financial Officer/City Treasurer to process the budget transfers during the fiscal year, which do not change the overall approved Net Budgets;
    6. That save and except the for the pre-qualification process for Project No. 3711RF - City of North Bay Community and Recreation Centre, Capital Project No. 3711RF will not proceed until further direction is received from Council regarding the tendering, construction and issuance of special debt; and
    7. That a By-Law be presented to Council for three readings on February 9, 2021 authorizing the expenditure of funds approved by the 2021 General Capital Budget and the 2021 Water and Wastewater Capital Budget.

    The General Government Committee presents Report No. 2021-03 and recommends:

    That:

    1. The 2021 Gross Operating Expenses included in the Operating Budget in the amount of $129,109,217 (save and except the District of Nipissing Social Services Administration Board levy of $12,820,073) be approved.
    2. The 2021 Tax Levy of $96,961,684 as summarized in attached Appendix A be approved.
    3. The Chief Financial Officer be authorized to process all transfers to and from reserve funds included in the 2021 Operating Budget.
    4. The Chief Financial Officer be authorized to transfer $13,715,309 from the Operating Fund to the Capital Fund to finance approved capital projects that would otherwise require debenture issuance to fund (Net Capital Levy in Operating Budget). This is often referred to as the “Pay As You Go” funding for capital projects.

    WHEREAS the COVID-19 pandemic has had significant financial and operational impacts on Ontario municipalities;

    AND WHEREAS municipalities have had to divert resources towards addressing the immediate needs of the pandemic and maintaining service delivery standards despite evolving restrictions and limited funds;

    AND WHEREAS the Government of Ontario has delayed timelines with respect to several pieces of legislation;

    AND WHEREAS the Government of Ontario has regulated municipal asset management through O. Reg. 588/17: Asset Management Planning for Municipal Infrastructure under the Infrastructure for Jobs and Prosperity Act, 2015;

    AND WHEREAS O. Reg. 588/17 mandates that every municipality shall prepare an asset management plan in respect of its core municipal infrastructure assets by July 1, 2021, and in respect of all of its other municipal infrastructure assets by July 1, 2023;

    AND WHEREAS the key components of an asset management plan as required by the regulation are:

    1. Infrastructure asset inventory
    2. Levels of service
    3. Lifecycle management and financial strategy

    AND WHEREAS there is a concern amongst Municipal Finance Officers’ Association of Ontario (MFOA) members and their municipalities that current capacity challenges (redeployment of staff, and lack of available resources) will result in limitations for purposeful asset management planning;

    AND WHEREAS Ontario municipalities do not anticipate the current capacity challenges to be resolved in the short-term;

    NOW THEREFORE BE IT RESOLVED that the Corporation of the City of North Bay supports MFOA’s letter to the Ministry of Infrastructure requesting a one-year extension of deadlines in O. Reg. 588/17: Asset Management Planning for Municipal Infrastructure under the Infrastructure for Jobs and Prosperity Act, 2015; so that all municipalities can focus on the immediate needs of the pandemic and engage in municipal asset management planning when capacity challenges are resolved.

    WHEREAS Schedule 6 of Bill 197, COVID-19 Economic Recovery Act, 2020 considers amendments to the Environmental Assessment Act relating to municipal autonomy and the principle that municipalities can veto a development outside their municipal boundary in an adjacent municipality;

    AND WHEREAS Bill 197 empowers multiple municipalities to ‘veto’ development of a landfilling site within a 3.5 km zone inside the boundary of an adjacent municipality;

    AND WHEREAS Bill 197 establishes a dangerous precedent that could be expanded to other types of development;

    AND WHEREAS Bill 197 compromises municipal autonomy and the authority of municipal councils to make informed decisions in the best interest of their communities and municipal taxpayers;

    AND WHEREAS amendments in Schedule 6 could cause conflict in the effective management of landfill sites, put significant pressure on existing landfill capacity, and threaten the economic activity associated with these sites;

    THEREFORE BE IT RESOLVED That the City of North Bay calls upon the Government of Ontario (Ministry of the Environment, Conservation and Parks (MOECP) to amend Bill 197, COVID-19 Economic Recovery Act, 2020, to eliminate the development approval requirement provisions from adjacent municipalities and that the ‘host’ municipality be empowered to render final approval for landfills within their jurisdiction.

    BE IT FURTHER RESOLVED that a copy of this motion be forwarded to Premier Doug Ford, Jeff Yurek the Minister of Environment, Conservation and Parks, Steve Clark the Minister of Municipal Affairs and Housing, M.P.P. Victor Fedeli, the Association of Ontario Municipalities (AMO), the Federation of Northern Ontario Municipalities (FONOM) and Ontario’s Big City Mayors (formerly Large Urban Mayors Caucus of Ontario-LUMCO).

    Whereas the Council of the City of North Bay is considering a new Community and Recreation Centre be built at the Steve Omischl field.

    Therefore Be It Resolved that Council direct the Chief Administrative Officer to prepare and present to Council a Business Plan for the operation of the new Community and Recreation Centre and associated grounds projected over twenty years which includes all expenses both operating and capital and the projected revenues to service these costs.
