    The Community Services Committee presents Report No. 2022-04 and recommends:

    “That Council:

    1. adopt a Property Standards By-Law, as set out in Report to Council CSBU 2022-002 from Beverley Hillier dated February 8, 2022 and repeal City of North Bay By-Law 2019-006 being a By-Law Providing Standards & Vital Services for the Maintenance of the Physical Condition and Occupancy of Property within the City (Property Standards By-Law), as amended;
    2. adopt a Clean Yards By-Law, as set out in Report to Council CSBU 2022-002 from Beverley Hillier dated February 8, 2022 and repeal City of North Bay By-Law 2011-185 being a By-Law Establishing Standards Respecting Exterior Property Maintenance and Grass Control on Residential Lands (Clean Yards By-Law), as amended;
    3. adopt a Vacant Buildings By-Law as set out in Report to Council CSBU 2022-002 from Beverley Hillier dated February 8, 2022; and
    4. amend Schedule “A” to City of North Bay By-Law 2019-07, User Fees, as set out in Report to Council CSBU 2022-002 from Beverley Hillier dated February 8, 2022.”

    1. the proposed Zoning By-law Amendment by Miller & Urso Surveying Inc. on behalf of 1633057 Ontario Ltd. and 1633091 Ontario Ltd. – 490 Gormanville Road in the City of North Bay to change the permitted uses to include a Microbrewery and a Restaurant within the existing “Industrial Commercial Special No. 55 (MC Sp. 55)” zone for the property legally described in Appendix A to Report to Council No. CSBU 2022-015 dated March 10, 2022 by Peter Carello be approved; and
    2. the subject property be placed under Site Plan Control pursuant to Section 41 of the Planning Act, R.S.O., 1990 as amended.”

    “That:
     

    1. the proposed Official Plan Amendment by Antech Design and Engineering Group on behalf of the property owner Golden Estates Limited – 392 Airport Road in the City of North Bay to amend the Official Plan Designation from “District Commercial” to “Residential” for a portion of the property legally described in Appendix A to Report to Council No. CSBU 2022-10 be approved; and
    2. the proposed Zoning By-law Amendment by Antech Design and Engineering Group on behalf of the property owner Golden Estates Limited – 392 Airport Road in the City of North Bay to rezone the property from a “District Commercial (C4)” zone to a “Residential Multiple Third Density Special (RM3 Sp.)” zone and a “Residential Multiple Third Density (RM3)” zone for a portion of the property legally described in Appendix A to Report to Council No. CSBU 2022-10 be approved; and
    3. the subject property be placed under Site Plan Control pursuant to Section 41 of the Planning Act, R.S.O., 1990 as amended.”

    2. the new Conditions of Approval requested by TransCanada Pipeline attached to Report to Council CSBU 2022-17 as Appendix “B” be added to the existing list of Conditions of Approval.

    2. the Conditions of Approval of the Draft Plan of Subdivision and a Draft Plan of Condominium be updated to reflect this new expiration date.

    Whereas Council received the attached letter from the City of Sarnia regarding Catch and Release Justice that is seen in communities throughout Ontario.  

    Therefore Be It Resolved that the Council of The Corporation of the City of North Bay endorses and supports the Motion from the City of Sarnia. 

    And Further that a copy of this motion be sent to the Right Honourable Justin Trudeau, Prime Minister of Canada, MP Anthony Rota, the Honourable David Lametti, Minister of Justice and Attorney General of Canada, the Honourable Doug Ford, Premier of Ontario, the Honourable Sylvia Jones, Solicitor General, MPP Victor Fedeli, Police Chief Scot Todd, North Bay Police Service and the City of Sarnia.

    RE: “Catch and Release” Justice

    At its meeting held on December 13, 2021, Sarnia City Council adopted the following resolution with respect to “Catch and Release Justice”:

    That the City of Sarnia send a letter to the Federal and Provincial Governments requesting meaningful improvements to the current state of “catch and release” justice in the Ontario legal system. Police Services across Ontario are exhausting precious time and resources having to manage the repeated arrests of the same offenders, which in turn, is impacting their morale, and ultimately law abiding citizens who are paying the often significant financial and emotional toll of this broken system. This resolution should also be sent to other Municipalities throughout Ontario for their endorsement consideration; and

    That the request also be referred to the Sarnia Police Services Board and be presented via AMO delegations for endorsement consideration.
